1. Agreement to Terms
By accessing and using Luxia ("Service", "we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These Terms apply to all users of Luxia, including visitors, registered users, and anyone who accesses or uses the Service.
2. Scope of Service
2.1 What Luxia Provides
Luxia is a Meta Ads intelligence platform that:
- Connects to your Meta advertising accounts via secure OAuth authentication
- Analyzes your advertising performance data and generates diagnostic reports
- Identifies optimization opportunities and performance issues
- Provides actionable recommendations based on your campaign data
- Creates dashboards and visualizations of your ad performance
- Optionally allows you to manage ads and catalogs based on your explicit actions (if you grant the necessary permissions)
2.2 What Luxia Does Not Do
Luxia does not:
- Execute actions on your advertising accounts without your explicit authorization
- Store your passwords or login credentials (we use OAuth tokens only)
- Guarantee specific performance improvements, ROI, or advertising results
- Provide financial, investment, or legal advice
- Share your advertising data with third parties for their marketing purposes
3. User Responsibilities
3.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- Keeping your email address and account information up to date
- Notifying us immediately of any unauthorized access or security breach
- All activities that occur under your account
3.2 Authorized Use
You agree to use Luxia only for legitimate business purposes and in a manner that does not infringe the rights of others. Prohibited behavior includes:
- Attempting to gain unauthorized access to our systems or other users' accounts
- Interfering with or disrupting the Service or servers
- Using the Service for any illegal or fraudulent activity
- Violating any applicable laws or regulations
- Harassing, abusing, or harming other users
- Reverse engineering, decompiling, or disassembling any part of the Service
3.3 Compliance with Platform Policies
You are responsible for ensuring your use of Luxia complies with Meta's Platform Terms, Advertising Policies, and any other applicable platform policies. Violations may result in suspension or termination of your Luxia account.
4. No Guarantees Disclaimer
4.1 Service Provided "As Is"
LUXIA AND ITS SUPPLIERS PROVIDE THE SERVICE "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, error-free, or completely secure. We make no warranties about the accuracy, reliability, or completeness of any content or data provided through the Service.
4.2 No Performance Guarantees
Luxia provides analysis and recommendations based on your advertising data, but we do not guarantee:
- Specific improvements in advertising performance or ROI
- Increased sales, conversions, or revenue
- Successful implementation of recommendations
- Accuracy of predictions or forecasts
Your advertising results depend on many factors outside our control, including market conditions, competition, ad creative quality, and your business model.
4.3 Third-Party Services
Luxia integrates with third-party platforms (Meta) via their APIs. We are not responsible for any changes, interruptions, or issues with these third-party services. Your use of third-party platforms is subject to their own terms and policies.
5. Limitation of Liability
5.1 Exclusion of Damages
IN NO EVENT SHALL LUXIA OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF LUXIA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
5.2 Maximum Liability
LUXIA'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO LUXIA IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
6. Intellectual Property
The content, features, and functionality of Luxia, including but not limited to all information, software, text, displays, images, video, and audio, are owned by Luxia, its licensors, or other providers of such material and are protected by copyright and other intellectual property laws.
You may not reproduce, republish, upload, post, transmit, or distribute any content from Luxia without our prior written permission.
Your advertising data remains your property. By using Luxia, you grant us a limited license to access, process, and analyze your data solely for the purpose of delivering our services.
7. Account Suspension and Termination
7.1 Termination by You
You may terminate your account at any time by contacting us at [email protected]. Upon termination, your data will be deleted in accordance with our Privacy Policy.
7.2 Termination by Luxia
Luxia may suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms of Service
- You engage in illegal or fraudulent activities
- You violate the policies of any connected platform (Meta)
- Your account poses a security risk to our systems or other users
- We are required to do so by law or regulation
7.3 Effect of Termination
Upon termination:
- Your access to Luxia will be immediately revoked
- Your account data will be retained in accordance with our Privacy Policy
- You remain responsible for any outstanding obligations
- Sections of these Terms that by their nature should survive termination will continue to apply
8. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by:
- Posting the updated Terms on this page with a new "Last Updated" date
- Sending you an email notification (if you have an active account)
- Displaying a prominent notice within the Luxia platform
Your continued use of Luxia after any changes indicates your acceptance of the updated Terms.
9. Dispute Resolution
9.1 Informal Resolution
Before initiating formal proceedings, you agree to attempt to resolve any dispute informally by contacting Luxia at [email protected]. We will work in good faith to resolve the issue within 30 days.
9.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Luxia is incorporated, without regard to its conflict of law provisions.
10. Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Luxia regarding your use of the Service and supersede all prior agreements, understandings, and negotiations.
